Stain And Seal Terms of Trade

1. Scope of Works
1.1 This quote includes only the works specifically listed in the quote.
1.2 Unless specifically stated, the quote does not include timber replacement, mould treatment, structural rectification, refastening, reframing, rebuild work, drainage correction, waterproofing works, or other remedial building works.
1.3 Any work outside the quoted scope will be treated as a variation and charged separately.

2. Hidden Defects and Unforeseen Issues

2.1 Removal of existing coatings may reveal hidden conditions not visible at the time of quoting.
2.2 Hidden defects and unforeseen issues may include rot, mould, timber failure, defective fasteners, subframe defects, structural issues, drainage issues, waterproofing issues, and non-compliant construction.
2.3 If hidden defects or unforeseen issues are discovered, additional costs, delays, or rescheduling may apply.
2.4 Works may pause until the issue is properly rectified.
2.5 Where appropriate, Stain And Seal may provide a variation or separate quote for rectification works. Alternatively, the client may arrange for rectification by others before works resume.


3. Structural and Subframe Issues
3.1 Stain And Seal does not inspect, certify, or accept responsibility for the structural adequacy, code compliance, or suitability of the deck or subframe unless specifically agreed in writing.
3.2 If subframe defects, structural defects, rot, movement, non-compliant construction, or other underlying issues are discovered, restoration works may need to stop until rectification is completed.
3.3 Where works involve replacing boards or building on top of an existing structure, the existing structure must be suitable for the intended works. If it is not, additional rectification will be required before works can proceed.


4. Fasteners

4.1 Minor fastening issues, including some proud, stripped, seized, or difficult screws, are a normal part of restoration and are allowed for within reason.
4.2 Widespread rusted, stripped, broken, seized, or otherwise unsuitable fasteners are not included unless specifically stated.
4.3 If widespread fastening failure is discovered, additional rectification, delay, or rescheduling may be required before works can continue.


5. Timber Repairs and Board Replacement
5.1 Timber repairs and board replacement are excluded unless specifically stated.
5.2 Unless otherwise stated in writing, board replacements are charged at $20 + GST per lineal metre, plus the cost of timber.
5.3 Replacement timber may vary in colour, grain, texture, and appearance from the existing deck.
6. Mould and Biological Growth
6.1 Mould treatment is excluded unless specifically stated.
6.2 If mould or mould-affected timber is discovered during preparation, additional treatment, delays, and costs may apply.
6.3 Mould-related work cannot always be priced in advance and may only be assessed once exposed.


7. Sanding and Preparation Limitations
7.1 Sanding and preparation are limited by tool size, physical access, board spacing, surrounding construction, and practical reach.
7.2 Tight edges, corners, gaps, and restricted areas may not be prepared to the same extent as open areas.
7.3 Minor splitting, chipping, breakout, or edge damage can occur during countersinking, fastening adjustment, sanding, and preparation despite reasonable care being taken.


8. Coating Limitations and Final Finish
8.1 Coating application is limited by access, weather conditions, and practical reach.
8.2 Final appearance may vary due to timber species, age, porosity, previous coatings, exposure, moisture, weather conditions, and natural variation in the timber.
8.3 Some stains, marks, weathering, mould staining, tannin staining, and existing damage may not be fully removable.
8.4 Lap marks, brush marks, finish variation, minor contamination, and other cosmetic imperfections can occur despite reasonable care being taken.
8.5 Minor incidental contact with surrounding areas may occur during sanding and coating, including nearby posts, walls, bricks, trims, and adjacent surfaces.


9. Dust
9.1 Dust extraction is used where practical, however dust is unavoidable during sanding.
9.2 Fine dust may continue to settle on surrounding areas after completion.
9.3 Unless otherwise agreed, the client is responsible for removing or protecting furniture, furnishings, and other items near the work area.


10. Weather, Drying, and Curing

10.1 Exterior coating work is weather-dependent. Rain, dew, moisture, humidity, temperature, sun exposure, and changing weather conditions can affect application, drying, curing, and final appearance.
10.2 Drying times, curing times, and maintenance intervals are estimates only and cannot be guaranteed.
10.3 Temporary whitening, discolouration, or other curing-related appearance changes caused by moisture exposure are not considered a defect where the coating remains otherwise sound.
10.4 Water-based coatings may take up to 7 days or longer to fully cure depending on weather and site conditions.


11. Oils and Product Behaviour

11.1 Penetrating oils may migrate onto adjoining or contacting surfaces, including stone, silicone, masonry, painted surfaces, and similar materials.
11.2 Excess oil may require later wipe-down or removal in some circumstances.
11.3 Product performance may vary depending on timber type, surface condition, application conditions, weather, and site exposure.


12. Maintenance

12.1 Ongoing maintenance remains the client’s responsibility.
12.2 Any advice given regarding maintenance timing, recoating, dry times, or product care is provided with care but cannot be guaranteed, as performance depends on weather, traffic, UV exposure, moisture, deck use, and other site-specific factors.


13. Site Access and Utilities
13.1 The client is responsible for providing safe and practical access to the work area.
13.2 Suitable site power must be provided by the client.
13.3 If site power trips more than twice, is unstable, or is otherwise unsuitable for the works, delays and additional costs may apply.
13.4 Where required, generator hire will be charged at $250 per day unless otherwise agreed.


14. Variations
14.1 Any work outside the quoted scope is a variation.
14.2 Variations will be charged in addition to the original quote.
14.3 Variations may affect the project timeframe.


15. Payment
15.1 Payment is due within 7 days of invoice date unless otherwise agreed in writing.
15.2 Accounts unpaid more than 14 days after the due date may incur a $25 administration fee and a 2% late fee.
15.3 Further administration fees and late fees may be applied at 28-day intervals while the account remains outstanding.
15.4 The client is liable for any reasonable debt recovery costs incurred in recovering overdue amounts.


16. Acceptance

16.1 By accepting a quote from Stain And Seal, the client agrees to these Terms of Trade.
16.2 These terms apply together with the accepted quote, and the quote will prevail to the extent of any direct inconsistency.
